Agreement & Conditions of "Short Term Residential" Tenancy
1. Reservation/Booking
To secure the booking we require:
- 50% of the total tariff for the period booked,
- Upon receipt of this deposit, we will forward your booking confirmation.
2. Payments
Can be made by
- Credit card (over the phone),
- Cheque, cash deposit or
- Internet/bank transfer.
- Please send notification of transfer together with your home address & phone numbers

3. Balance of Payment
The total tariff and security bond is required 7 days prior to arrival.
4. Security Deposit
An additional security deposit is required until the tenancy is completed. The security deposit is refunded to you by cheque or internet bank transfer within seven (7) working days following an inspection, provided the property is left in the same condition as at the start of the tenancy and there have been no incidents involving security call outs, (see "Noise" para 17 & 21).

- Weekly stay $1,000
- Schoolies/Blues/Splendor $2,500
- Christmas/New Years $2,000
5. Occupation
Is only available if the
- total tariff and security bond is paid in full
6. Arrival and Departure times
Generally occupation is available from
- 4.00pm on the day of arrival and
- premises to be vacated by 10.00am.
- Times other than this require prior arrangement.
7. House Manager
A house manager must be nominated as the primary contact.
- A major responsibility of the HM is to ensure that all occupants understand and agree to rules of occupancy.
- Mobile phone numbers to be provided and to be contactable when occupying the residence 24/7 for security purposes.
8. Number of Occupants
The property provides sleeping accommodation for a
- Maximum of 8 adults, sleeping in 3 Queen beds, 2 Single beds,
- Number of guests booked is the maximum allowed
- This will be strictly enforced.
- Only those guests booked into the house are to stay.
- Additional guests (other than those booked) will be charged at $100 per person per night.
- The property is to be fully secured when unattended
9. Property Usage
The property is to be used for:
- Short-term residential accommodation only.
- The property may not be used for any commercial purpose,
- Wedding, party, gathering or any other function.
10. Garbage
Garbage to be put into plastic bags and then placed into the bin.
- Recyclable rubbish and garbage must be placed in appropriate bins.
- Bin lids must close snugly.
- Arrangements must be made to dispose of all garbage and recyclable rubbish that will not fit into bins provided.
- You will be charged for trips made to the tip
- No surplus rubbish is to be placed in the street.
- Bins to go out Thursday night.?
- Recyclable bin is picked up every two weeks.
11. Parking
The number of vehicles is
- Not to exceed 2
- Strictly no parking in the driveway of the house please
- No parking on the footpath or playground /park area as the council will book you
- There is ample parking on the streeet
- No parking in the driveway of Number 2 (adjoining premises) as the neighbour will not then be able to access garage.
12. No Responsibility
The owners take no responsibility for
- Loss of tenant's property, or personal injury
13. Breakage & Damage
The tenant is responsible for
- Any breakage's or damage to property or contents,
- Lost keys charged at $100.
- Any other loss to the property incurred during the tenancy.
- These must be reported, replaced or paid for.
- The amount will be confirmed by e-mail and deducted from the bond
14. Cleaning
Tenant is required to leave the property in the same clean, neat & tidy condition, as it was when they arrived. Including;
- washing up;
- removal of food from fridge or cupboards;
- ensuring BBQ is cleaned; and
- Removal of excess rubbish, that will not fit in our bin.
- At the owner's discretion, any additional cleaning or removal of excess rubbish required will be paid for by the tenant or deducted from the security deposit.
- Bed and bath linen is supplied for the number of guests occupying the premises – additional charges will be made for excess use of linen.
15. Smoking
At no times is smoking permitted inside the premises.
In addition, we do not permit smoking on the deck after 10.00pm as we have had complaints from the neighbours that the ensuing conversation disturbs their sleep.
No presence is permitted on the deck after 10.00pm
This is a Council requirement for all holiday letting premises in Byron Bay.
16. Pets
No pets or animals allowed.
17. Noise
No noise or inappropriate behaviour is acceptable to neighbours 24/7.
- No noise between 10pm to 8am.
- Clear verandas between 10pm and 8am.
- (Noise means any sound that can be heard from neighbouring properties that disturbs their peace and quiet.)
- Tenants must not create any noise on arrivals and departures throughout their stay.
- (This means no one in the neighbourhood is woken by any means.)
- A $165 deduction will be taken from the security deposit with each security callout. Should it be necessary for our House Manager to call regarding a security call out, a further $35 charge will apply for her visit.
- After one warning for noise, tenants will be evicted with no refunds.
18. Cancelled Bookings
A cancellation administration fee of $100 will apply in all circumstances.
- If the period booked by you is fully re-booked, only the cancellation fee will be charged and the balance refunded.
- If the period booked by you is not re-booked, only the security bond will be refunded, less the cancellation fee.
19. Breaches
A breach of any of the above conditions will permit the owner's
- to cancel or amend a booking,
- refuse access or occupation, or
- immediately terminate a tenancy.
- Refunds will not be paid on terminated tenancies.
20. Security
The property will be regularly and randomly visited by our security guard from Cape Byron Security.
- The Security Guard: has the right to enter the property if necessary to check the number of guests, the condition of the premises and the noise emitted.
- The security guard has permission to the check the IDs of persons staying in the house.
21. More About Noise
- The property is located in a residential area
- No excess noise from Stereos, TV's, DVD's or other electronic equipment, loud voices etc. is to be made at anytime.
- For the comfort of other guests and neighbours no noise should be audible outside the property after 10pm and before 7.30am.
- This is a council imposed rule in Byron Bay
- Clear verandas between 10pm and 8am. (Noise means any sound that can be heard from neighboring properties that disturbs their peace and quiet.)
- You are advised that the creation of offensive noise is an offence under the provisions of the Protection of the Environment Operations Act 1997.
- The maximum penalty that a court may impose on a person for contravening this direction is $3,300.
- After one warning for noise, tenants will be evicted with no refunds.
This Tenancy agreement is between the owners listed above and the tenant listed below. Receiving these Terms and Conditions confirms agreement.
You are also required to sign the Agreement below.
